On 20 July 2022, the USPTO and WIPO agreed to work together to promote the resolution of disputes involving standard essential patents, or SEPs. SEPs are patents declared essential to a given technical standard, and licensing discussions often involve FRAND terms across areas such as video compression, wireless communications, computer connectivity standards and automotive technology.
The memorandum of understanding says the two organizations will cooperate by using existing WIPO Arbitration and Mediation Center resources and USPTO resources to support activities that improve the efficiency and effectiveness of SEP dispute resolution. They will also conduct outreach through joint projects to increase stakeholders’ understanding of WIPO’s arbitration and mediation services.
The agreement is effective for five years from the date of signature.
