The Belgian Intellectual Property Office (OPRI) is responsible for administering the country's patent affairs. Strikingly similar to its neighbor, the Netherlands, the Belgian national patent system exclusively offers invention patents with a 20-year term, does not have a utility model system, and operates on a grant mechanism without substantive examination. Following the filing, applicants are required to request a prior art search conducted by the European Patent Office (EPO). Upon receipt of the search report, the patent is automatically granted provided that the formal requirements are satisfied, regardless of whether the invention actually meets the substantive criteria of novelty and inventive step. This mechanism aims to lower the barrier to entry for IP protection, effectively shifting the burden of validity scrutiny to post-grant judicial proceedings.

Judicially, the Brussels Enterprise Court holds exclusive jurisdiction over patent disputes in Belgium. The Belgian litigation framework features a powerful evidence-gathering procedure known as the infringement seizure (Saisie-contrefaçon), similar to the French system. Authorized by a judge, this allows rightsholders to execute unannounced raids to secure evidence of infringement, providing a substantial strategic advantage at the onset of enforcement.

From a macro IP strategy perspective, Belgium's most compelling attraction for patentees lies in its exceptionally favorable tax incentive framework—the Innovation Income Deduction (IID) regime, which is fully compliant with the OECD's BEPS Action Plan. Under the IID, Belgian companies or multinational branches located in Belgium can benefit from an 85% deduction on net income derived from qualifying intellectual property, including patents and copyrighted software. This effectively reduces the effective corporate tax rate on IP revenues to a very low single-digit percentage. This highly competitive tax environment, combined with Belgium's geographic position at the heart of Europe, makes it an ideal hub for tech and pharmaceutical companies to structure their global patent portfolios and licensing operations.
